Lifespan Skills (First Aid Division) – Terms & Conditions
In these terms and conditions of trading LSF means Lifespan Skills (First Aid).
The Client means the person(s), Company or Organisation to whom the services of LSF are provided. All First Aid Courses are run in conjunction with Adventure Lifesigns Group (HSE No: 128/00)
BOOKINGS. Bookings can be made by email, fax, letter or telephone. Telephone bookings must be confirmed in writing within 7 days. Payment can be made by credit/debit card or cheque payable to “S. Hoddinott”.
A deposit of 25% of the full cost of the course is payable at the time of booking (if booked more than two weeks prior to the course start date) to confirm the place.
The full balance is due 2 weeks prior to the start of the course. Certificates will only be issued on receipt of full payment and successful completion of the course.
FEES. Fees are valid for 30 days from the date of quotation. The LFS invoice will be raised when the Clients’ order is confirmed. Where the fee is not paid at the time of order, the fee must be paid within 30 days of the invoice date. LSF reserve the right to charge interest on any overdue account at the rate of 3% over the base lending rate of Lloyds TSB Bank plc in force at the date of invoice. Such interest shall accrue on a daily basis. All fees are quoted ‘per student’ and all courses have a maximum number of students as detailed on the LSF literature. In certain circumstances, further students may be allowed to attend the course but LSF reserves the right to charge ‘per student’ fee for additional students who attend.
All course fees include cost of administration, documentation, use of equipment, aide-memories, all course notes, use of training materials, light refreshments and certification. Lunch is not provided unless otherwise stated.
CANCELLATIONS. LSF reserves the right to cancel or postpone any course. If this becomes necessary, as much notice as possible will be given and the client will be offered a choice, with due consultation to
a full refund, if the course has not yet commenced
a proportionate refund, if the course has commenced and is not yet completed
an alternative date to commence or complete the course
as appropriate to the circumstance.
If the client requests cancellation or postponement of any course, no fees will be payable provided that not less than 28 days written notice is given to LSF. If less than 28 days written notice is given, LSF reserve the right to make an appropriate charge for administrative and other expenses as follows:
21 to 28 days written notice prior to course commencement = 25% of course fee
14 to 21 days written notice prior to course commencement = 50% of course fee
7 to 14 days written notice prior to course commencement = 75% of course fee
less than 7 days written notice prior to course commencement = 100% of course fee
In exceptional circumstances and at the discretion of LSF, a course or places on a course may be postponed rather than cancelled. In cases where a course or a place on the course is immediately rearranged to an alternative date and therefore only postponed, cancellation fees will not be payable. Further cancellation or postponement of an already rearranged course or place on a course would be subject to a mandatory 100% cancellation fee irrespective of the amount of prior written notice given.
FAILURE TO ATTEND. Notwithstanding the provision of clause 2 above, of any student fails to attend any course or any part of any course on which a place has been reserved, fees in respect of that student will be payable in full. However, if the course on which the place has been reserved for a student has not yet commences, a substitute student may be nominated for that course.
If the course on which a place has been reserved for a student has commenced but for exceptional reason the student has not be able to complete the course, an alternative date will be offered to enable the student to complete the remaining part of the course. Exceptional reasons include illness supported by a doctor’s report or self-certification or compassionate grounds.
At the discretion of the LSF Course Leader, if an insufficient number of students attend any one-day, the course or part of the course may be postponed or cancelled in accordance with clause 2 above.
SUITABILITY. Students selected for training must be those who are reliable
and likely to remain calm in an emergency. In addition, they should have the aptitude and ability to cope with an intense course of study and be able to use the knowledge and skills learnt during the course. For certain courses, students must not suffer from any medical or other condition which would restrict their ability to undertake practical work which can be an essential part of the training. If a student is considered unsuitable in the opinion of the LSF Course Leader, with due consultation the student may be asked to leave the course. In this event, LSF reserves the right to retain the fee or proportion of the fee for that student. In all cases, students must comply with the course pre-entry qualification requirements, as exceptions will not be made.
PROPERTY OF LSF. Any equipment and training materials supplies by LSF remain the property of LSF, apart from free issue course notes and other such material, which will be clearly identified. All such material is copyright by Adventure Lifesigns Group and no copying or publishing of any part of it is permitted without written permission of Adventure Lifesigns Group.
INSURANCE. All venues hired/used by LSF will have public liability insurance in place. With Client’s providing their own venue (for In-House training), proof of insurance is required to include accidental damage to equipment and public liability.
HEALTH AND SAFETY: The Client is required to ensure compliance with any Legislation, Regulation, Code of Practice or Guidance laid down by the Health and Safety Executive with regard to the suitability of premises provided for courses at a Client provided venue. LSF will request details of the course venue (eg1.34m per person regarding training room size) before course confirmation.
LSF produce full risk assessments pertaining to training courses and undertake a dynamic risk assessment at the venues. Where appropriate, students will be advised of any possible hazards which may be present during the course of training and procedures they should adopt to minimise the risk pertaining to the hazards.
DISCLAIMER. LSF shall not be liable for any loss, damage, expenses, injury or delay of any kind to the Client, employee of the Client or any third party, by any act, default or omission howsoever caused, except insofar as such liability cannot be excluded by law.
ALTERATION. LSF reserved the right to amend these terms and conditions without prior notification. English Law shall govern these Terms and Conditions of Trading. Any alterations, modifications or extensions affecting the above clauses shall not be valid unless agreed by LFS and acknowledged in writing.
